The petitioners seek bail in Bounsi P.S. Case No. 187 of 2014, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, petitioners have been made accused in this case on the basis of call detail report (CDR) for murder of one person namely, Naresh Yadav. It is submitted on behalf of the petitioners that petitioners are not named in the FIR and they have falsely been implicated in this case. Save and except call detail report there is

Patna High Court CR. MISC. No.68485 of 2021(2) dt.03-03-2022 2/2 no tangible material which shows their complicity in the alleged occurrence. Similarly situated co-accused has been granted bail by this Court. Petitioner nos. 1 and 2 are in custody since 16.08.2021 and petitioner nos. 3 and 4 are in custody since 24.08.2021. Petitioners claim clean antecedent. Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Banka in connection with Bounsi P.S.
