JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and victim made attempt to break the barrier of religion and dreamt of flying in open air but unfortunately, petitioner was caught by the cold hands of the law. The victim was found by learned Magistrate aged about 15 years whereas the Medical Board found the age of the victim between 14 to 16 years. No doubt, the victim was minor, as per the prosecution case, at the time of alleged occurrence but she was about to attain the majority and she, specifically, stated in her statement recorded under section 164 of the Cr.P.C that she solemnized her marriage with the petitioner and she wants to lead her married life along with the petitioner.
Patna High Court Cr.Misc. No.22505 of 2015 (2) dt.03-07-2015 2/2 Accordingly, above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Danapur, Patna in connection with Dulhin Bazar P.S.Case No. 01 of 2015.
