The petitioner seeks bail in Dumra P.S. Case No. 329 of 2021, registered for the offence punishable punishable under Section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.
72.450 litres of illicit liquor has been recovered from a tempo and one motorcycle and this petitioner was driving the said motorcycle.
It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is not the owner of vehicles in question and has got no concern with the seized liquor. Petitioner is in custody since 05.09.2021. Investigation is complete.
Patna High Court CR. MISC. No.67897 of 2021(2) dt.21-12-2021 2/2 Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and three cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise Act, Sitamarhi in connection with Dumra P.S.
