JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 20-09-2023 Learned counsel for the petitioners submits that petitioner no. 2 namely, Pankaj Ram @ Pandey has been arrested, accordingly, he seeks permissions to withdraw the application against petitioner no. 2, namely, Pankaj Ram @ Pandey.

3.Accordingly, this Criminal Miscellaneous application is dismissed as withdrawn against petitioner no. 2, namely Pankaj Ram @ Pandey and the application is restricted to petitioner no. 1, namely Pappu Ram.

4. Heard learned counsel for the petitioner no. 1 and learned APP for the State.

5. The petitioner no. 1, namely Pappu Ram apprehends his arrest in connection with Karamchat P.S. Case No. 54 of 2023 dated 04.07.2023 instituted for the offence punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code.

6. The allegation against the petitioner no. 1, namely Pappu Ram is that he assaulted the husband of informant with lathi causing injury to him due to previous land dispute.

7. Learned counsel for the petitioner no. 1 submits that petitioner no. 1 has been falsely implicated in this case due to land dispute. He further submits that there is a case lodged by the police in which the specific allegation is that the injured was in Drunken condition. Later on taking advantage of the situation, the wife of the injured has mala fidely lodged this false case due to previous dispute. Petitioner no. 1 has one criminal antecedent in which he is on bail.

8. Learned APP opposes the prayer for anticipatory bail.

9. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner no.1 above named Pappu Ram

No.58262 of 2023(2) dt.20-09-2023 3/3 be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Karamchat P.S. Case No. 54 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
