Patna High Court Cr.Misc. No.30603 of 2015 (2) dt.22-07-2015 2/3 anticipatory bail of petitioner nos. 1 and 2 since similarly situated co-accused persons have been granted anticipatory bail by this Court. This Court earlier disposed of the anticipatory bail application of the petitioners with observation that the learned court below consider the prayer for regular bail of petitioner nos. 1 and 2, if they surrender within a period of six weeks. The modification has been sought for on the ground that the petitioners are old person and by the petitioners' side lodged a case at earlier point of time and informant side having similar accusation has been granted anticipatory bail.
Keeping in view of the fact that earlier the application of the petitioners was disposed of, this Court is not inclined to entertain the present modification application. However, in view of the nature of accusation and the fact that there being counter version when others have been granted anticipatory bail, the period of surrender is extended by four weeks from the date of receipt/production of a copy of this order in connection with Ghanshyampur P.S. Case No. 191 of 2014 pending in the court of learned SDJM, Biraul at Benipur. It is expected from the learned court below to consider the prayer for regular bail of petitioner nos.
Patna High Court Cr.Misc. No.30603 of 2015 (2) dt.22-07-2015 3/3 granted anticipatory bail and dispose of the same preferably on the same.
Accordingly, this modification application is disposed of.
