JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioners are languishing in custody since 13.02.2015 in connection with Jamo Bazar P.S. Case No. 122 of 2014 for the offences instituted under Sections 341, 323, 307,379 of the I.P.C. Later on, Section 302 of the IPC was also added. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 27.11.2014 at about 4.30 P.M. the informant's co-villager Yado Lal Rai has cut sugarcane from his field then the informant proceeded towards the house said Yado Lal Rai but he could not find him there. Thereafter, when the informant was returning from Baldiha Bazar then near the house of Mogal Rai, Yado Lal Rai, Laxmi Rai,
Patna High Court Cr.Misc. No.23591 of 2015 (3) dt.12-08-2015 2/2 Chinta Rai and Ranjan Kumar assaulted the informant by Farsa, Lathi and Garasi then the informant received injury on his head and blood was oozing out from the head of the informant. In the meantime, his nephew came to save him but he was also assaulted, in the meantime, Yado Lal Rai also took away Rs. 5000/- from the pocket of the informant, thereafter, the villagers came and saved them and brought them to the hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.02.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. It is further submitted that the general and omnibus allegation has been made against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Jamo Bazar P.S.
