The Petitioner seeks bail in Baikunthpur P.S. Case No. 118 of 2018 registered for the offence punishable under Sections 302 of the Indian Penal Code.

Allegation against the petitioner is of assaulting the son and uncle of the Informant for non fulfillment of demand of Toddy on account of which they sustained injuries. The uncle of the Informant was taken to hospital where the Doctor declared him brought dead.

It has been submitted on behalf of the petitioner that there was no intention of the petitioner to kill rather it happened during the spur of the moment. Petitioner has got no criminal antecedent and is in custody since 27.05.2018. Considering the direct allegation against the

Patna High Court Cr.Misc. No.56766 of 2018(3) dt.01-11-2018 2/2 petitioner, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the trial court is directed to expedite the trial of the petitioner and conclude the same within a period of one year from the date of receipt/production of a copy of this order and if the trial of the petitioner is not concluded within a period of one year, petitioner would be at liberty to renew his prayer for bail.
