The petitioner seeks bail in Phulparas P.S. Case No. 61/2018, instituted for the offences under Sections 147, 148, 149, 341, 302, 504 and 506 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that in the written report, it is alleged that father of the informant sustained gun shot injury caused by Sanjay Yadav and Md. Gulzar Miyan and subsequently he died. The petitioner is only alleged to be present at the place of occurrence.

Post-mortem report is available in case diary, wherein doctor has found two firearm injuries on the person of

Patna High Court Cr.Misc. No.57029 of 2018 (3) dt.29-10-2018 2/2 deceased caused by firearm.

Petitioner is in custody since 09.04.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate IInd, Jhanjharpur, Madhubani in connection with Phulparas P.S. Case No. 61/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Rakhi U T
