The petitioners apprehend their arrest in Madanpur P. S. Case No. 142 of 2016 registered for the offences under Sections 308, 325 and others sections of the Indian Penal Code. The informant alleged that Devan Yadav and his two sons, namely, Jitendra Yadav (petitioner no.3) and Santosh Yadav (petitioner no.2) finding her alone in her house, came and snatched her mangalsutra chain made of Gold. On protest, Jitendra Yadav, Devan Yadav and Santosh Yadav are alleged to have assaulted the informant causing fracture on her leg and injury on her head. Indu Devi, Rita Kumari and Rinku Devi are

Learned counsel for the petitioners submits that the informant did not receive any grievous injury. All the injuries are simple in nature. On account of land dispute, this false case has been lodged.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the petitioners are neighbour of the informant and the informant got simple injury, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Madanpur P. S. Case No. 142 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
