ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.07.2019 in connection with Gopalpur (Rangra) P.S. Case No.384 of 2018 registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the main allegation of firing is against Devendra Singh and not the petitioner. The only allegation as against the petitioner is that he is a member of the crowd and other similarly situated persons, including Jiwan Singh @ Jeevan Singh and Umesh Singh have since been granted the privilege of regular bail by this Court in Cr.Misc. No.38227 of 2019 and Cr.Misc. No.6814 of 2019, vide orders dated 01.07.2019 and

Patna High Court CR. MISC. No.54858 of 2019(2) dt.04-09-2019 2/2 29.03.2019 respectively.

Considering the aforementioned facts and circumstances and that the petitioner has not been attributed any particular role in the present case and also that he has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge, Naugachia, District-Bhagalpur, in connection with Gopalpur (Rangra) P.S. Case No.384 of 2018.
