2. The petitioner, who is in custody since 10.10.2017, has renewed his prayer for bail in connection with Sessions Trial No. 31 of 2018 arising out of Katoria P.S. Case No. 171 of 2017 having earlier been rejected by order dated 19.04.2018 in Criminal Miscellaneous No. 23161 of 2018.

3. It is submitted that the petitioner has been falsely implicated in the backdrop of land dispute and there is case and counter case between the parties who happen to be own brothers. Other co-accused Dinu Yadav @ Dinesh Yadav @ Dinesh Kumar Yadav and Bandhu Yadav have been granted bail by this Court in Cr. Misc. No. 78508 of 2018 and Cr. Misc. No. 23161 of 2018 respectively. The petitioner claims clean antecedents.

4. Pursuant to order dated 19.09.2019 status report dated 25.09.2019 has been received, according to which the trial is ongoing and deposition of three witnesses have already been recorded out of the 10 chargesheet witnesses.

5. Having regard to the nature of accusations and the gravity of the offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The petition stands dismissed with observation that the learned trial court is expected to proceed with the trial and conclude the same expeditiously.
