The petitioner is apprehending his arrest in connection with Gaighat @ Gayghat Police Station Case No.135 of 2017 registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

Provisional bail was granted to the petitioner in this case by a co-ordinate Bench of this Court, vide order dated 06.10.2018 while calling for case diary, considering the fact that petitioner had leveled serious allegation against the Block Development Officer, who is informant of this case before lodging of the present complaint.

Submission of learned counsel for the petitioner is that allegation is of not depositing the receipt of disbursement of

Patna High Court Cr.Misc. No.57052 of 2018(3) dt.30-11-2018 2/2 Rs.20,00,000/- (Rupees Twenty Lacs) of pension scheme. Submission is that Annexure 2 is details of the receipts which were submitted long back and just for extraneous consideration the F.I.R. has been lodged.

Finding substance in the submission aforesaid, let provisional bail granted to the petitioner, vide order dated 06.10.2018 be confirmed.
