Petitioner, who is in custody, seeks bail in connection with Brahmpura P.S. Case No. 195 of 2017 (G.R. No. 4076 of 2017) registered for the offences punishable under Sections 406, 364, 379 and 34 of the Indian Penal Code. Allegation against petitioner is recovery of stolen ready made garments and bundle of clothes, which was loaded in a truck to unload the same to different place. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion. He has no concern with the alleged recovery. He is not named in FIR.
Patna High Court Cr.Misc. No.56770 of 2018(3) dt.29-10-2018 2/2 Nothing has been recovered from the possession of the petitioner. He is in custody since 01.06.2018. It has been further submitted that earlier petitioner has been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 47888 of 2018 vide order dated 13.09.2018 in Lalganj P.S. Case No. 206 of 2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 195 of 2017.
