The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 393 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per F.I.R is that when the informant along with his brother were entered into the bank, co-accused persons tried to snatch the bag of the informant and opened fire. It is alleged that on
Patna High Court CR. MISC. No.68212 of 2021(3) dt.27-09-2022 2/3 raising the alarm by the brother of the informant, local police came and the accused persons fled away from the place of occurrence.
It is submitted by learned counsel for the petitioner that petitioner was not named in the F.I.R and his name surfaced during the course of investigation. It is further submitted that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner and he has been implicated in this case due to his previous criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case
