VI Incharge, Sitamarhi is that non-bailable warrant of arrest and processes under Sections 82 and 83 Cr.P.C. were issued against the Petitioners, who were declared absconders on 19.5.2012 and the case was fixed for evidence under Section 299 Cr.P.C. which was closed on the prayer of the A.P.P. and it was ordered that the records be deposited in the Record Room and so no judgment was pronounced. Now the Trial Court has got the records out and hence the Petitioners are directed to appear before the Court below within a period of three weeks from the date of receipt of this order. On their
Patna High Court CR. REV. No.393 of 2014 dt.22-02-2016 2/2 appearance, the Petitioners shall be released on bail on furnishing bail bond of Rs. 5,000/-(Five thousand) each with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of learned Adhoc Additional Sessions Judge VI, Sitamarhi in connection with Sessions Trial No.349 of 2003 arising out of Sahiyara P.S. Case No.27 of 1994, subject to the conditions, subject to the conditions (i) That one of the bailor will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will undertake to furnish information to the Court about any change in address of the petitioners. (ii) That the petitioners will be well represented on each date if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
The application stands disposed of.
