The petitioner is accused in connection with Mojahidpur (Babarganj) P.S. Case No. 33 of 2016 registered under Sections 380, 452, 341, 323, 504 and 506/34 of the Indian Penal Code.
The allegation of informant is that there was dispute in between him and the petitioner in respect to transaction of money. The dispute was resolved on giving Rs.10,000/- by the informant to the petitioner. But on 25.02.2016, the petitioner and his friend came at the home of informant and took away his two motorcycles. At that time the petitioner also made an attempt to make fire and threatened him fpr dire consequences. Learned counsel for the petitioner submits that

No.27576 of 2016 (2) dt.11-07-2016 informant took Rs. 30,000/- to the petitioner in spite of repeated demand only Rs.10,000/- was returned by the informant to the petitioner and making demand the remaining amount the informant had lodged this false case only to give undue pressure. Moreover, in course of investigation, two alleged looted motorcycle was found near the door of the petitioner. The petitioner is in custody since 04.04.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur (Babarganj) P.S. Case No. 33 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
