This is a petition for grant of regular bail for offence under Section 379 of the Indian Penal Code.
The F.I.R. of the occurrence of theft is against unknown.
Submission of the learned counsel for the petitioner is that the person who had confessed before the police has already been granted bail by the learned court below and the person from whose possession recovery was made has already been granted bail by the learned court below, whereas the prayer for bail of the petitioner was refused.
Considering the aforesaid facts, the petitioner, above
Patna High Court Cr.Misc. No.12305 of 2018 (2) dt.28-02-2018 2/2 named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Patna in connection with Patna Junction (G.R.P.) (Patna Saheb) P.S. Case No. 163/2017. The District Judge, Patna shall enquire about the correctness of the aforesaid fact as well as reason for such conflicting order passed by the same level of Court in connection with Patna Junction P.S. Case No. 163/2017.
