The petitioner is languishing in custody since 12.07.2019 in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

The prosecution case is that on 04.06.2019 the daughter of the informant, aged 13 years, Manisha Kumari went missing on 05.06.2019. When the informant went to the house of the petitioner to enquire about it, then the petitioner conveyed that his son, co-accused Sandeep Kumar Yadav has kidnapped the daughter of the informant and he is also missing. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.54996 of 2019(3) dt.20-11-2019 2/2 that the thrust of accusation is against co-accused Sandeep Kumar Yadav. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP after going through the case diary submits that the petitioner has kidnapped the victim, the daughter of the informant and she is still traceless. Considering the thrust of accusation against coaccused Sandeep Kumar Yadav, the son of the petitioner and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 268 of 2019.
