JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 The petitioner is apprehending his arrest in connection with CI/992/14, registered for offences punishable under Sections 498A/34/494 of Indian Penal Code and Section 4 of Dowry Prohibition Act.

It has been submitted on behalf of the petitioner that though petitioner is husband and the case is under Section 498A but opposite party no. 2-complainant, herself has stated on oath that she has received money and is not ready to live with the petitioner and with consent she has left the petitioner in panchayati.

Heard learned A.P.P. also.

No.12560 of 2017 (3) dt.03-04-2017 2/2 Having heard both sides, in view of submission of learned counsel for the petitioner, let petitioner surrender before the court below on 18.04.2017 and the court below shall release the petitioner on provisional bail to his satisfaction and thereafter, the court below shall fix a date, on which date, both the parties shall remain physically present and the court below after verifying the above submissions of learned counsel for the petitioner, shall confirm the provisional bail of the petitioner, otherwise the court below shall pass any appropriate order as it deems fit and proper. With the above observation, this application is disposed of.
