The petitioner apprehends her arrest in Masaurhi P.S. Case No. 418 of 2015 registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code. The informant alleged that his Samadhi (father-in-law of daughter of the informant) informed his wife about death of his daughter Kajal Devi. The daughter of the informant was married to Sonu Das two years ago. The informant further alleged that Sonu Das, his father and mother, the petitioner, were demanding laptop, ornaments and Rs. 50,000/-.
Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased. The petitioner never demanded any dowry nor tortured her daughter-in-law, the
Patna High Court Cr.Misc. No.30453 of 2016 (3) dt.27-10-2016 2/2 deceased. No external injury was found on the body of the deceased. The viscera report was kept reserved. No specific allegation is made against the petitioner.
Considering the facts aforesaid and the fact that the petitioner is mother-in-law and no specific allegation is made against the petitioner, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Masaurhi, Patna in Masaurhi P.S. Case No. 418 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
