Petitioners apprehend their arrest in connection with Nokha P. S. Case No. 155 of 2016 registered for the offence punishable under Sections 306/34 of the Indian Penal Code. Allegedly, the petitioners and co-accused Rakesh Kumar Singh abused and assaulted Neeraj Kumar Singh, the husband of the informant resulting, he consumed poison and thereafter he died, when he was being brought to Sasaram. Submission is of false implication and that the occurrence is of 18.06.2016 and fardbeyan has been lodged on

Patna High Court Cr.Misc. No.3684 of 2017 (2) dt.14-02-2017 2/2 19.6.2016 after delay of one day.

However, now the informant has filed compromise petition and there is no witnesses to support the case as made out in her fardbeyan and as such the petitioners deserve sympathetic consideration. The petitioner No. 1 and 2 are ladies and wife of own brothers of the deceased, whereas the petitioner No. 3 is father-in-law of own brother of the deceased. Learned A.P.P. fairly submits that now the informant is retracting from her earlier version.

In the facts and circumstances state above, the petitioners above named, in case of their surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Vth Rohtas, Sasaram in connection with Nokha P. S. Case No. 155 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C. (Jitendra Mohan Sharma, J) Sudha/- U T
