JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Garkha P.S.Case No. 272 of 2016 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. Allegation against the petitioner, who happens to be husband of deceased, is of killing of his wife due to demand of Rs.25,000/- and motorcycle and deceased was killed within one year of marriage and disposed of the dead body hurriedly. Submission of learned counsel for the petitioner is that she has committed suicide and thereafter informant was informed about her death and petitioner is in custody since 12.6.2018.
Heard learned APP also, who has opposed the prayer for bail stating that witnesses have supported the story of demand of dowry and death was caused within one year of
Patna High Court Cr.Misc. No.57922 of 2018(4) dt.05-11-2018 2/2 marriage and dead body was disposed of in hurried manner. Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
This application is, accordingly, dismissed.
