JUSTICE RAJIV ROY ORAL ORDER 19-07-2023 No one appears on behalf of the petitioner although learned counsel for the State is present The present writ petition has been filed for the following reliefs:- (i) for issuance of a writ in the nature of writ of mandamus directing the respondent authorities to continue the service of the petitioner on the post of Assistant manager in
Patna High Court CWJC No.18625 of 2019(2) dt.19-07-2023 2/3 Ghosiya Primary Agriculture Credit Co-operative Society herein after referred as PACS in accordance with by laws of the society and remove the person who is illegally functioning/working in place of petitioner in collusion with PACS Chairman of Ghosiya.
(ii) for issuance of a writ in the nature of writ of mandamus directing the respondent authorities to ensure compliance of his own order passed in favour of the petitioner regarding his function and continue him on the post of Assistant manager in his concerned PACS which was/is being deliberately ignored by concerned Chairman of PACS;
(iii) for issuance of writ in the nature of writ of mandamus directing the respondent Chairman of Ghosiya PACS to remove the illegally appointed Assistant Manager in place of petitioner and hand over the record of the society to petitioner and the financial transaction of PACS may be made in the knowledge as well as with the signature of the petitioner (Assistant PACS Manager);
This Court has gone through the reasoned order passed by the court of Munsif, Sadar, Sitamarhi and do not find any error in it.
Accordingly, the writ petition is misconceived and the
Patna High Court CWJC No.18625 of 2019(2) dt.19-07-2023 3/3 same stands dismissed.
