JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 370 and 370A of the I.P.C. and Sections 23/26 of the Juvenile Justice (Care & Protection of Children) Act, 2015.

The prosecution story, in brief, is that on the basis of information that one Raj Kumar brought some girls from West Bengal and pressing them to dance, the informant along with police personnel raided the house, from where seven girls and two boys recovered in suspicious position and on enquiry by the Assistant of N.G.O. and assisted by Sena Nayak Amit Kumar they have told that it is Raj Kapoor i.e. the petitioner, who had brought them after enticing them and forced them to dance and the petitioner disclosed that main leader is Mahesh of village Yadopur.

Patna High Court Cr.Misc. No.30535 of 2016 (4) dt.08-09-2016 It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.3.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be the owner of the Orchestra party, where the victim girls were working. The said victims have been examined under Section 161 of the Cr.P.C. It is admitted by them that they had come to work in the Orchestra party but they are not being given their wages. It seems due to the dispute in respect to wages, the present case has been instituted.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Chhauradano P.S. case No.25 of 2016.
