Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sono P.S. Case No. 265 of 2021 lodged under Sections 419, 420, 379 of the Indian Penal Code and section 66(c) of I.T. Act. As per the prosecution, total Rs.97,940/- was credited from the informant's bank account through his credit card. Learned counsel for the petitioner submits that petitioner has not named in the F.I.R.. Accused of this case is the holder of mobile no.7027216239. Learned counsel for the petitioner further submits that he has nothing to do with the said mobile no. The said mobile no. belongs to one Dharmendra

Patna High Court CR. MISC. No.56320 of 2022(2) dt.20-10-2022 2/3 Kumar Singh and petitioner is no where in connection with the said Dharmendra Kumar Singh. He also submits that the said amount has been transferred by Dharmendra Kumar Singh into the account of one Raja Ram, who is also accused in this case and Raja Ram is the holder of CSP and petitioner is also the holder of CSP. They are well known to each other and Raja Ram has alleged to transfer this money in the petitioner's account. It is due to this reason, the name of the petitioner has come in this case. Learned counsel specifically submits that he filed a supplementary affidavit in which he has annexed Annexure-5 by which it transpires that the said Raja Ram has returned the entire amount to the informant. He further submits that petitioner is ready to face the trial, he is in custody since 15.08.2022 and his criminal antecedent is clean.

Learned counsel for the State opposes the prayer for bail but submits it transpires from Annexure-5 that the informant has received his amount from other co-accused. In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned J. M.Ist Class, Jamui in connection

Patna High Court CR. MISC. No.56320 of 2022(2) dt.20-10-2022 3/3 with Sono P.S. Case No. 265 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
