The petitioner apprehends his arrest in connection with Risiup P.S. Case No. 09 of 2017 registered under Sections 379, 411, 420/34 of the Indian Penal Code and 3/4/5 of the Bihar Illegal Mines Act an 3(c) of the Prevention of Damage of Public Property Act.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused persons namely, Abdul Kamil Siddique @ Abdul Kamil and Nasim Ansari have already been allowed anticipatory bail by this Court vide Cr. Misc. No. 11538 of 2017. It is also submitted that petitioner has no criminal antecedent.

No.14423 of 2017 (4) dt.07-06-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad in connection with Risiup P.S. Case No. 09 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
