The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.
It is a case of abduction of the minor daughter of the informant by co-accused Sri Patel.
It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the main allegation of abduction is against co-accused Sri Patel and not against these petitioners and they
Patna High Court CR. MISC. No.68038 of 2021(3) dt.26-07-2022 2/2 have no concern with the said offence. He further submits that the victim was recovered and got recorded her statement under section 164 of the Cr.P.C. in which she has not implicated the name of these petitioners or any one in commission of the offence.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge-cum-Special Judge (POCSO), Bettiah, West Champaran in connection with Sikta P.S. Case No. 43 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
