The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 467, 468, 471, 420 and 201 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 3429.360 litres of IMFL was recovered from the truck in question and the petitioner who is the khalasi of the truck was taken into custody. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 6.6.2022 (Annexure-1) passed in Cr. Misc. no. 71118 of 2021 giving liberty to the petitioner to renew his
Patna High Court CR. MISC. No.56204 of 2022(2) dt.09-11-2022 2/2 prayer for bail on completing one year in custody. The petitioner is in custody since 16.9.2021.
Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 6.6.2022 together with the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Sadar P.S. Case no. 643 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Court II, Muzaffarpur.
