Petitioner, who is in custody, seeks bail in connection with Munger Muffasil P.S. Case No. 52 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 307 and 504 of the Indian Penal Code and Section 27 of Arms Act.

Allegation against the petitioner is of abusing and firing upon the chest of the informant with an intention to kill him.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case due to dirty village politics and family dispute. F.I.R. has

Patna High Court Cr.Misc. No.56879 of 2018(4) dt.06-11-2018 2/2 been lodged after five days of the alleged occurrence and there is no explanation of delay in lodging the F.I.R. The nature of injury is simple. Petitioner is in custody since 18.06.2018 and he has no criminal antecedent.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Muffasil P.S. Case No. 52 of 2017.
