The petitioner seeks bail in Marhowrah (Gaura O.P) P.S. Case No. 752 of 2020, registered for the offence under Section 394 of the Indian Penal Code.

As per the prosecution case, four miscreants riding on a Maruti Car intercepted the pick-up van of the informant and assaulted him by fists and slaps and thereafter, fled away with mobile phone and pick-up van of the informant. It is submitted on behalf of petitioner that name of the petitioner surfaced during course of investigation in the confessional statement of co-accused Ankit Kumar. Only material, which has come against the petitioner, is that the call details report (C.D.R.) of petitioner's mobile reveals that he was in touch with the accused persons on the alleged date and time of occurrence. Petitioner is in custody since 01.09.2021.

Patna High Court CR. MISC. No.68609 of 2021(2) dt.03-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran in connection with Marhowrah (Gaura O.P) P.S.
