The petitioner is languishing in custody since 15.09.2014 in a case registered for the offences punishable under Sections 20(b)(ii)(c)/21(c)/22/23/24 of the NDPS Act. The petitioner was intercepted while going on bicycle and from a bag hanging on the bicycle seven packets of charas weighing total three and half kgs. were recovered. It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner.
Considering the recovery of the commercial
Patna High Court Cr.Misc. No.23532 of 2015 (2) dt.14-07-2015 2/2 quantity of the contraband, this Court is not inclined to grant bail to the petitioner in connection with NDPS Case No. 64 of 2014 arising out of Rail Raxaul P.S. Case No. 15 of 2014 pending in the court of learned 3rd Additional Sessions Judge -cum- Special Judge, Motihari, East Champaran.
Accordingly, the prayer for bail of the petitioner is rejected.
Let the trial be expedited.
