ANJANA MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Piprasi P.S. Case No. 02 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 325, 427, 307, 379, 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is case and counter case between the parties. The petitioners have
Patna High Court Cr.Misc. No.30563 of 2016 (2) dt.02-09-2016 2/2 also lodged Piprasi P.S. Case No. 01 of 2016 on 29.01.2016 wherein one of the injured on the side of the petitioners was seriously injured and thereafter he succumbed to his injury. So far as the petitioners are concerned, they also alleged to have attacked but the allegation are general and omnibus in nature and no particular role can be attributed to the injuries purported to have been inflicted.
Considering the nature of allegations made, the case and counter case and also because petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Bagha, West Champaran in connection with Piprasi P.S. Case No. 02 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
