Petitioner is apprehending his arrest in Bhabua P.S. Case No.109 of 2015 registered under sections 448, 354(B), 307, 504 of the Indian Penal Code and 27 of the Arms Act. The allegation, in brief, is that the petitioner entered into the house of the informant inebriated condition, started abusing her and tried to outrage her modesty, she objected then he shot with a country made pistol which missed but again he fired, the informant caught the pistol with her hand causing firearm injury in her finger.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent. Further it has been

No.23565 of 2015 (2) dt.06-07-2015 2/2 submitted that the injury sustained by the informant is on a nonvital part of the body hence he had no intention to commit murder of the informant. Further it has been submitted that the matter has been settled between the parties which is stated in paragraph 12 of the bail petition.

On behalf of the State he has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances and also taking into consideration the fact that the matter has already been settled, between the parties, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua (Kaimur) in Bhabua P.S. Case no. 109 of 2015, subject to the conditions as laid down under section 438(20 Cr.P.C.
