The petitioners being the brothers and married sister of the husband of the daughter of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 302, 498A/34 of the Indian Penal Code.
The prosecution case is that the informant got his daughter Suman Devi married with co-accused
Patna High Court Cr.Misc. No.30366 of 2016 (4) dt.03-10-2016 Mahendra Bharti in the month of March, 2007. On 28.01.2016 the informant got information that accused persons killed the daughter of the informant. It is submitted by the learned counsel for the petitioners that petitioners have no connection with the victim's husband. Petitioner no. 1 resides at Varanashi, whereas petitioner nos. 2 and 3 are residing at New Delhi. During investigation, it transpires that victim fought with her husband Mahendra Bharti thereafter she committed suicide. There is no eye witness to the occurrence. Learned A.P.P. Mr. J.N. Thakur, after going through the cased diary submits that there is no eye witness to the occurrence and this fact has also transpired during investigation that the victim committed suicide. Post-mortem reflects strangulation caused by hanging. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Saran at Chapra in connection with Manjhi P.S. Case No. 23 of 2016, subject to conditions as laid
