This application for anticipatory bail arises out of Barari P.S. Case No. 73 of 2019 for the offence punishable under Sections 341, 323, 354(A), 427, 504 and 506/34 of the Indian Penal Code.
Petitioners No. 1 and 2 are the brothers of the husband of the informant and petitioner No.3 is the nephew of the informant. It is alleged in the First Information Report that the petitioners and others had abused the informant on 07.01.2019 and on 06.03.2019, they had called her Dain and again assaulted her.
It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.53120 of 2019(2) dt.26-08-2019 2/2 family feud is the reason behind lodging of the First Information Report. It has also been argued that other cases have also been filed against petitioners No. 1 and 2 by the informant's side. Considering the nature of allegation, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Katihar, in Barari P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
