JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-07-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 504, 353/34, 147 and 509/34 of the Indian Penal Code. It is a case of assault upon the informant by the accused persons including the petitioners.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the informant is the resident of same village and the close relative of the defeated candidate for the post of

He further submits that it is admitted that the dispute arose during selection of the Samiti as the informant herself indulged in grouping and wanted to select the man of her choice and the villagers protested her choice and to this effect are also the part of the police investigation. Petitioners have got clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri K.S. Deou, Judicial Magistrate, Supaul/ concerned Court in connection with Pipra P.S. Case No. 155 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
