The petitioner is apprehending his arrest in connection with Turkauliya P.S. Case No. 449 of 2016 for the offences instituted under Sections 341, 323, 379, 504 and 509/34 of the Indian Penal Code and Sections 3/4 of the Witchcraft Practices Prohibition Act, 1999.
As per prosecution case, the allegation is that all the seven FIR named accused came at the house of the informant, abused her and tossed her. Co-accused Sita Devi administered obnoxious substance inside the mouth of the informant and allegedly snatched golden ear tops of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no specific
Patna High Court Cr.Misc. No.5447 of 2017 (2) dt.06-02-2017 2/2 allegation against this petitioner. The allegation of administering obnoxious substance is against co-accused Sita Devi and both the parties are resident of same locality and the accused persons are agnate of the informant.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Turkauliya P.S. Case No. 449 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
