JUSTICE SANJAY PRIYA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jaynagar P.S. Case No. 35 of 2017 (CRI Case No. 185 of 2017) instituted for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that petitioner is in custody in the instant case since 18.10.2017. He is not named in the written report. His name has come in the confessional statement of other co-accused persons. Thereafter, police recorded confession of this petitioner also. The co-accused namely Krishnadeo Singh @ Parnami Singh with similar allegation has already been granted bail by a coordinate Bench of this Court vide order dated 30.08.2018 passed in Cr. Misc. 33487

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani, in connection with Jaynagar P.S. Case No. 35 of 2017 (CRI Case No. 185 of 2017), subject to the condition that both the bailors will be the close relatives of the petitioner.
