JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Bandhuwa Kurawa P.S.Case No. 20 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is of assault to the deceased, who happened to be his wife, and caused her death by strangulation, as he had illicit relationship with some other lady. Submission of learned counsel for the petitioner is that marriage was solemnized more than seven years prior to the occurrence and no injury was found on the person of deceased as per post mortem report, rather deceased had committed suicide and petitioner is in custody for more than five months. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.56173 of 2018(3) dt.05-11-2018 2/2 circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Banka, in connection with Bandhuwa Kurawa P.S.Case No. 20 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
