JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks regular bail in connection with S.T. No. 119 of 2019 arising out of Andhrathadi P.S. Case No. 57 of 2015, registered for the offences punishable under Sections 396, 397, 120B of IPC.

Earlier prayer for bail of the petitioner was rejected, vide order dated 05.10.2018, passed in Criminal Misc. No. 52337 of 2018. Though the case is under Sections 396 and 397 of IPC, the name of petitioner transpired in the confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that petitioner is in custody since 13.04.2018 and earlier liberty was given to the petitioner to renew his prayer for bail after framing of charge and now the charge has been framed. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.53405 of 2019(2) dt.28-08-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge, Jhanjharpur, Madhubani, in connection with S.T. No. 119 of 2019 arising out of Andhrathadi P.S. Case No. 57 of 2015, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he is to appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
