2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 342, 379, 34 of the Indian Penal Code and later on added sections 395 and 412 of the I.P.C.

3. As per prosecution case, some miscreants are alleged to have committed theft huge quantity of wire, scrap of conductor, electric conductor etc. from the godown situated at village Jasari.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He is not named in the FIR and falsely been implicated in this case. During course of investigation, one co-accused as well as this

On the basis of which, it is said that some stolen material were recovered but nothing has been recovered from possession of the petitioner. It is pertinent to mention here that the confession before police is inadmissible in the eye of law. The petitioner has got no criminal antecedent as stated para-3 of the bail petition and languishing in judicial custody since 8.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Thali P.S. Case No. 124 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada.
