2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 310(2) of the B.N.S.

3. The case of the prosecution is that the informant's company was establishing a 2 mega watt solar power project near a canal near Patna. On 09.04.2025 at about 11:50 PM, 2025 miscreants arrived at the site, confined two security guards and stole all the equipment worth Rs. 40 lacs.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.58568 of 2025(2) dt.27-08-2025 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted by learned counsel for the petitioner that the FIR was lodged against unknown miscreants and his name has surfaced in this case on the basis of confessional statement of Abhishek Rai. He has further submitted that Abhishek Rai and other coaccused person have already been granted bail by learned coordinate Bench of this Court vide order dated 12.08.2025 in Cr. Misc. No. 56031 of 2025. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 30.04.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bikram P.S. Case No. 149 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and
