The petitioner apprehends his arrest in Kudra P.S. Case No. 128 of 2015, registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.

The petitioner took 4500 quintals of paddy and he had to give 3015 quintals rice but he did not deposit 1665 quintals of rice. The petitioner has to deposit Rs. 29,18,711.45. The petitioner is ready to deposit 20% of the aforesaid amount of Rs. 29,18,711.45 within four months.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of

Patna High Court Cr.Misc. No.23431 of 2015 (2) dt.08-07-2015 2/2 receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudra P.S. Case No. 128/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

If the petitioner fails to deposit 20% of the total amount of Rs. 29,18,711.45 within four months from the date of receipt/production of this order, learned court below shall cancel the bail bond of the petitioner.
