Petitioner prays for bail in connection with Forbesganj P.S.Case No. 440 of 2018 registered for the offences punishable under Sections 457 an 380 of the Indian Penal Code. Allegation as per FIR is of commission of theft in the house of the informant and miscreants have taken away TV, utensils, ornaments, etc. from the house.

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and recovered articles have not been put on T.I. Parade and petitioner is in custody for about four months and though he is accused in four other cases but after his arrest in this case he has been remanded in other cases.

Heard learned APP also.

No.58050 of 2018(3) dt.01-11-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S.Case No. 440 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
