The petitioner apprehends his arrest in Baligaon P.S. Case No. 51 of 2021, registered for the offences punishable under Sections 406/420 of the Indian Penal Code. Prosecution case in brief is that informant and petitioner entered into an agreement for sale of 74.5 decimals and total consideration money of Rs. 15 lakhs was also paid. Later on, petitioner refused to execute the sale deed in favour of informant and abused also.

It is submitted that entire case is false and fabricated and not a single farthing has been received by the petitioner and in support of this fact Annexure-2 is annexed with this petition. In fact, there was some dispute in between the elder brother of petitioner, namely Umesh Prasad Singh and Rajeev Kumar (informant) because the informant wanted to grab the property

Patna High Court CR. MISC. No.67715 of 2021(2) dt.18-07-2022 2/2 of Umesh Singh at cheap rate, therefore, he sold his land to another person with the advice of petitioner. Informant by committing forgery has prepared a false agreement between the petitioner and himself. Moreover, it is a case of civil dispute. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 51 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
