JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-06-2015 Heard learned counsels for the petitioner and the State. The petitioner being brother's wife of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B,328 and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after about six years of marriage for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that that the accusation against the petitioner is not specific. The husband of the victim and other co accused have been acquitted vide judgment dated 22nd November, 2012 passed in S.T. No. 427 of 2012 as none of the witnesses have supported the prosecution

Considering the fact that petitioner is a lady and the husband of the victim has already been acquitted, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Hayaghat P.S. Case No. 73 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
Since the case was instituted in 2012 and the petitioner has preferred application for anticipatory bail in 2015, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions.
