ANJANA MISHRA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 19-09-2016 Heard Mr. Raghunath Singh, learned Counsel, appearing on behalf of the petitioner, and Mr. Partha Sarthi, learned Government Advocate No.11, appearing on behalf of the State-respondents.

Considering the fact that this writ petition, which has been filed, in the nature of Public Interest Litigation, under Article 226 of the Constitution of India, brings it out that the land,

Patna High Court CWJC No.11838 of 2016 (2) dt.19-09-2016 2/2 which forms part of Anabad Public Aam Land pertaining to Khata No.1851, Plot No.878, Mauza Dakhram, Thana No.142, Revenue P.S. Bahera, Anchal- Benipur, is being encroached upon and illegal construction of houses are being done by respondent Nos.5 to 11, we close this writ application with a direction to the respondents, particularly, respondent No.2, namely, the Collector, Darbhanga, to ensure that the encroachers are removed within a period of four months from today and, upon removal of encroachers, a report, in writing, shall be submitted by respondent No.2, namely, the Collector, Darbhanga, to the Registrar General of this Court.

In terms of the above observations and directions, this application shall stand disposed of.

Let a copy of this order be made available to the learned Counsel for the petitioner for being transmitted to the Collector, Darbhanga.

Let also a copy of this order be sent by FAX to the Collector, Darbhanga.
