JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Biddupur P.S. Case No. 314 of 2016 instituted for the offence under Sections 341, 323, 307, 379 and 504 of the Indian Penal Code. There is allegation against the petitioner that he assaulted with bricks on the head of the son of the informant. It has been submitted that the other co-accused person has been granted anticipatory bail by the learned Sessions Judge vide order dated 19.12.2016 passed in A.B.P. No. 2312 of 2016 in which it is mentioned that son of the informant sustained only one injury on the left side of forehead. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent. Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.9604 of 2017 (2) dt.07-03-2017 2/2 prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Biddupur P.S. Case No. 314 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
