JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Mahua P.S.Case No. 273 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is that on hearing sound of firing the informant woke up and the accused persons, including the petitioner, having pistol in his hand, were standing there and his father was lying in injured condition and accused persons fled away.

Submission of learned counsel for the petitioner is that there is land dispute between the parties from before and though there is allegation against the petitioner that he is said to have armed with pistol but nobody has seen that it is the petitioner who fired shot at the deceased and moreover

Patna High Court Cr.Misc. No.59245 of 2018(3) dt.05-11-2018 2/2 petitioner is in custody since 4.6.2018.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail. Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, petitioner may renew his prayer for bail after framing of charge.

With the above observation, this application is dismissed.
