Petitioners, who are in custody, seek bail in connection with Katoria P.S. Case No. 189 of 2017 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Informant has alleged that petitioners (in-law's of the deceased) along with his family member killed her daughter due to non-fulfillment of demand of dowry.
It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They have been falsely implicated in this case only on suspicion. Allegation against petitioners are general and omnibus in nature.
Patna High Court Cr.Misc. No.58779 of 2018(3) dt.25-10-2018 2/2 Petitioners have been living separately from the husband and wife (deceased) and have no concern with them. They have no criminal antecedent.
Petitioners have earlier moved to another coordinate Bench of this Court for bail vide Cr. Misc. No. 10964 of 2018 which was rejected on 04.04.2018. Petitioners are in custody since 02.06.2018.
Considering the aforesaid facts and circumstances of the case and the observation made in order dated 04.04.2018 passed in Cr. Misc. No. 10964 of 2018, petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2, Banka in connection with S.T. No. 40 of 2018 arising out of Katoria P.S. Case No. 189 of 2017.
